the Queen's Proctor together with a description of the said land goods or Vessel and the xotimated value thereof...
In case the value of the vessel and goods or seizure of goods shall and exceed the sum of fifty dollars - The Queen's Proctor shall enter a claim for condemnation of the said vessel and goods describing them, and he shall cause notice of his having done so to be affixed for the period of one calendar month on the door
of the Court House.
The hearing of such claim shall take place at the next sitting of Vice Admiralty which shall be held on the month next but one after that in which the Vessel + goods - Vessel or goods shall have been delivered into the custody of the Marshal The evidence - in support of such claim and also in support of any Counterclaim which may be made in respect of such property as aforesaid shall be taken viva voce upon oath (except in the case hereinafter provided for) in open Court and the Judge at such hearing either condemn or order restitution of the vessel and goods or live or foods as the case may be.
In cases where there shall be danger of losing the testimony of any of them in consequence of him being ordered away from the Colony on promotion he the Judge may upon application made in Chambers in that behalf (such application to be supported by an affidavit grounding) can order for the examination of such person to be taken and such order being made the Registrar shall take the evidence of such person
